2. Our services

Lost Profits Lab provides business records review and revenue leakage identification services.

Depending on the package or individual agreement, services may include:

  • Reviewing business records to identify potentially completed work that has not been invoiced.

  • Comparing job records with invoices to identify missing charges or discrepancies.

  • Comparing materials and supplier costs against amounts invoiced.

  • Identifying potentially omitted labour, materials, call-out charges or additional work.

  • Comparing quotations with subsequent invoices.

  • Reviewing invoice calculations and identifying possible duplicate or inconsistent entries.

  • Producing reports highlighting potential billing errors, outstanding invoice balances and areas requiring further investigation.

  • Providing management information relating to job costs, pricing and profitability, where agreed.

The exact services, deliverables, frequency and fees will be confirmed before work begins.

We do not guarantee that every billing error, omitted charge or potential revenue loss will be identified.

3. Nature and limitations of the service

Our services are intended to help businesses identify potential discrepancies and areas requiring attention within the records supplied to us.

Unless expressly agreed otherwise in writing:

  • We do not provide statutory audits or independent financial audits.

  • We are not acting as the client's accountant, auditor, solicitor or tax adviser.

  • We do not prepare or submit tax returns or VAT returns.

  • We do not provide regulated financial advice.

  • We do not collect debts or contact a client's customers to pursue payment.

  • We do not guarantee that identified amounts are recoverable or legally payable.

  • We do not replace the client's accounting software, bookkeeping system or professional advisers.

Our reports and findings are informational. The client remains responsible for checking the underlying records, deciding what action to take and obtaining professional advice where appropriate.

4. Client responsibilities

The client agrees to:

  • Provide accurate, complete and relevant information reasonably required for the agreed service.

  • Ensure that they are entitled to provide the records and information supplied to us.

  • Remove or obscure personal information that is not necessary for the work.

  • Inform us of any limitations, omissions or known inaccuracies in the supplied records.

  • Review reports and raise any questions or corrections promptly.

  • Make their own decisions about invoices, accounting entries, customer communications, tax treatment and business operations.

We are not responsible for errors or omissions resulting from incomplete, inaccurate, misleading or outdated information supplied by the client.

5. Personal and confidential information

Clients should provide the minimum information necessary for the agreed work.

Where possible, customer names, contact details, addresses and other identifying information should be removed before records are supplied.

If personal information is required for a particular service, the parties will establish their respective data protection responsibilities before that information is processed. Where we act as a data processor, an appropriate written data processing agreement must be in place.

We will treat commercially sensitive and confidential business information supplied by clients as confidential, subject to disclosures required by law or necessary to provide the agreed service.

Further information is available in our Privacy Policy.

6. Fees and payment

The applicable fees will be confirmed in writing before work begins.

Depending on the service, fees may be charged as:

  • A one-off fee for an individual review or report.

  • A recurring monthly subscription.

  • A separately agreed fee for additional work outside the original scope.

Invoices must be paid by the payment deadline stated on the relevant invoice.

Any additional work or changes to the agreed scope may result in additional charges. We will seek the client's agreement before undertaking chargeable additional work.

7. Monthly services and cancellation

Where a service is provided on a monthly subscription basis, the agreed subscription price, billing frequency, included work and cancellation arrangements will be confirmed before the subscription starts.

Unless a different arrangement is agreed in writing, either party may end a rolling monthly service by giving 30 days' written notice.

Fees for work already completed and any agreed charges incurred before termination remain payable.

Any prepaid fees relating to work not yet provided will be dealt with in accordance with the relevant service agreement and applicable law.

8. Reports and findings

Reports are based on the information and records made available to us.

A finding may identify a potential discrepancy, omission or area for investigation. It should not automatically be treated as proof that money is owed, that an invoice is legally enforceable or that an accounting or tax entry is incorrect.

The client is responsible for verifying findings against its original records and obtaining advice from its accountant or other professional adviser where necessary.

9. Intellectual property

Unless otherwise agreed in writing, our pre-existing methods, templates, processes, working materials and general know-how remain our property.

Once all applicable fees have been paid, the client may use the reports and deliverables prepared specifically for them for their own internal business purposes.

The client must not resell, publish or commercially distribute our templates, methods or materials as a standalone product without our written permission.

10. Limitation of liability

We will provide our services with reasonable care and skill.

We do not accept responsibility for losses arising from inaccurate, incomplete or misleading information supplied by the client, or from decisions taken by the client based on findings that have not been independently verified.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation.

Subject to that restriction, our liability will be limited to the maximum extent permitted by applicable law. Any specific financial liability cap agreed with a client will be stated in the relevant service agreement.

11. Changes to these terms

We may update these Terms from time to time.

The version applicable to a particular service will normally be the version in force when the client agrees to that service, unless a later change is agreed or required by law.

12. Complaints and questions

If you have a question or complaint about a service, please contact:

Email: admin@lostprofitslab.com

We will review the matter and aim to respond within a reasonable period.

13. Governing law

These Terms and any dispute arising from them will be governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, subject to any mandatory legal rights that apply.

14. Acceptance

By agreeing to a quotation, service proposal, subscription or other written service arrangement with Lost Profits Lab, the client agrees to the applicable Terms and Conditions.
